Why non-EU manufacturers need an Authorized Representative

What an EU Authorized Representative does under GPSR and Regulation (EU) 2019/1020, what is at risk without one and why a passive provider is not enough.

The EU single market offers immense opportunities for non-EU manufacturers. However, selling products in Europe requires more than shipping goods: it requires compliance with strict regulations. The General Product Safety Regulation (GPSR, EU 2023/988), which applies since 13 December 2024, sets higher standards for product safety, traceability and cross-border e-commerce.
Your legal contact in the EU
A key requirement for non-EU manufacturers is a legal contact established in the EU. The GPSR (Art. 16) and, for most CE-marked products, Regulation (EU) 2019/1020 (Art. 4) require an economic operator in the EU. This can be an importer or, in some cases, a fulfilment service provider. For manufacturers selling from outside the EU, it is usually an EU Authorized Representative (AR).
The AR is a natural or legal person established in the EU with a written mandate from the manufacturer (Art. 3(12) of Regulation (EU) 2019/1020). It acts on your behalf to support compliance, manage documentation, liaise with authorities and coordinate recalls.
What the Authorized Representative does
The AR keeps the Declaration of Conformity available to market surveillance authorities and makes sure the technical documentation can be provided on request (Art. 4(3)(a) of Regulation (EU) 2019/1020). It communicates with the authorities and cooperates on corrective actions and recalls. Its name and contact details appear on the product, its packaging, the parcel or an accompanying document (Art. 4(4) of Regulation (EU) 2019/1020, Art. 16(3) GPSR).
Depending on the applicable act, the Declaration of Conformity names the manufacturer or its authorized representative. Products that fall only under GPSR have no Declaration of Conformity. For them, the technical documentation under Art. 9(2) GPSR is the central document.

Without an AR or another economic operator in the EU, your products risk:
