GPSR compliance: essential tips for non-EU manufacturers

Since 13 December 2024, the EU General Product Safety Regulation (GPSR, EU 2023/988) applies, and non-EU manufacturers face stricter safety, documentation and supply chain transparency requirements. For small and mid-sized manufacturers, meeting these requirements can be challenging. 1. Appoint a trusted EU representative (Responsible Person)

Products covered by GPSR may only be placed on the EU market if an economic operator established in the EU is responsible for them (Art. 16(1)). Non-EU manufacturers without an EU importer therefore designate an EU-based Responsible Person (RP) to act as the face of their brand for EU authorities and customers. The RP's name and contact details appear on the product, its packaging, the parcel or an accompanying document (Art. 16(3)).

The RP verifies the documentation, regularly checks that the product matches the technical documentation and the labeling and instruction requirements (Art. 16(2)) and communicates with regulators. Choose a provider that reviews your files rather than one that only lends an address.

2. Digitize compliance documentation

GPSR requires manufacturers to draw up technical documentation before placing a product on the market, keep it up to date and keep it available to market surveillance authorities for 10 years (Art. 9(2) and (3)). It also requires traceability: a type, batch or serial number on the product (Art. 9(5)) and, on request, information on suppliers and customers (Art. 15(3)). Digitized documents allow faster responses to customer inquiries and regulatory inspections.

3. Build a transparent supply chain

Traceability is essential under GPSR, and it also builds customer trust. Every economic operator must be able to tell authorities, on request, who supplied the product and to whom it was supplied, for six years (Art. 15(3) and (5)). Batch or serial numbers on the product and records of suppliers and distributors let you locate affected products quickly if a safety issue occurs.

4. Customize labels and instructions
